Digitek MDL sent to West Virginia

The MDL Panel has ruled that the Digitek MDL will be consolidated in the United States District Court for the Southern District of West Virginia. The case has been assigned to Chief Judge Joseph R. Goodwin in Charleston, West Virginia.

Actavis Totowa (the makers of Digitek) Recalls Drugs From New Jersey Facility

Actavis Totowa LLC, (the maker of Digitek) announced a voluntary recall of all drug products manufactured at its Little Falls, New Jersey facility. This recall follows an inspection conducted by the Food and Drug Administration earlier this year.

Digitek Multi-District Litigation Panel (MDL) Hearing

Since I am handling several Digitek lawsuits, I attended the Digitek MDL hearing in San Francisco last week. No one opposed consolidation of the cases, but there were several alternative venues offered. If I were a gambling man, I would bet that they are transferred to New Jersey (home of Actavis) or West Virginia (home of Mylan).

For those who don't know, Digitek is a drug that was placed on the market with double the intended dose, causing digitalis toxicity --which can lead to cardiac instability, stroke, death, vomiting, nausea, low blood pressure and bradychardia.

Just yesterday, Actavis issued a voluntary recall of all drugs (not just Digitek) made at its Little Falls, New Jersey facility.
